4. Description of the Service

4.1 What ÀJÀLÁ Provides

ÀJÀLÁ is a real-time transit navigation platform specifically engineered for the informal public transit ecosystem of Lagos, Nigeria. The Service utilises a graph-based navigation engine and crowdsourced community intelligence to assist Users in navigating the city's informal transit network, which includes:

  • Danfo minibuses (yellow commercial buses);
  • Keke Napep (auto-rickshaw trishaws);
  • Bus Rapid Transit (BRT) services.

The Service currently includes, without limitation, the following features:

  • Community-Sourced Route Intelligence: Turn-by-turn or stage-by-stage route guidance based on aggregated community data;
  • Fare Estimation: Approximate cost guidance for routes based on crowdsourced pricing data;
  • Conductor Shouts: Localised, community-contributed boarding phrases used at specific bus stops and loading bays;
  • Live Traffic Reports: Crowdsourced road condition updates (e.g., traffic congestion or clear roads);
  • Guardian Mode: A safety feature enabling real-time trip-sharing with trusted contacts;
  • Account Management: User profile creation, Ajala ID assignment, and Safe Contact management.

4.2 ÀJÀLÁ Is a Guide, Not a Carrier

ÀJÀLÁ is a software-based information and navigation platform. We do not own, operate, control, manage, hire, contract, or employ any vehicle, driver, conductor, or transit operator. We are not a transportation provider, logistics company, or carrier of any kind. The Platform does not book rides or guarantee transit availability. Your decision to board or use any vehicle based on information provided by the Platform is entirely your own decision and is made at your sole risk.

4.3 Service Availability

We strive to maintain continuous availability of the Platform; however, we do not guarantee uninterrupted, error-free, or secure access. The Service may be suspended, restricted, or unavailable at any time due to scheduled maintenance, technical failures, third-party service outages, or circumstances beyond our reasonable control.

5. Nature of Transit Data — Disclaimer of Accuracy

5.1 Estimated and Crowdsourced Data

All transit data provided by the Platform, including but not limited to route information, fare estimates, travel duration estimates, and Conductor Shouts, are estimates based on crowdsourced community intelligence and algorithmically processed real-world observations. They are not guaranteed to be accurate, complete, current, or reliable.

5.2 The Lagos Factor

The informal transit environment of Lagos is inherently dynamic, unpredictable, and subject to rapid change. Without limitation, the following events and circumstances are common, foreseeable, and entirely outside our control:

  • Fare increases or changes imposed unilaterally by drivers, conductors, or transport unions;
  • Route changes, road diversions, or sudden closures due to construction, flooding, protests, or government directives;
  • Vehicle unavailability, breakdowns, or strikes by transport operators;
  • Significant traffic delays, gridlock, or "go-slow" conditions not yet reflected in Platform data;
  • Real-world conditions that differ materially from the information displayed on the Platform.

IMPORTANT: You acknowledge that the Platform provides guidance, not guarantees. You assume full responsibility for verifying transit information before and during your journey. Always exercise your own judgment and make independent inquiries with drivers, conductors, and other commuters as appropriate.

5.3 No Liability for Data Inaccuracy

We expressly disclaim any and all liability arising from your reliance on Transit Data provided by the Platform. Please refer to Section 13 (Limitation of Liability) for the full extent of our liability limitations.

6. Guardian Mode — Location Sharing & Safety Feature

6.1 Feature Description

Guardian Mode is an opt-in safety feature that enables you to share your precise, real-time GPS location and live trip progress with one or more individuals designated by you as Safe Contacts (also referred to as "Guardians"). Safe Contacts are linked to your Account using their unique Ajala ID.

6.2 Express Consent

By activating Guardian Mode for any trip, you explicitly and freely consent to the following:

  • The continuous collection and transmission of your precise GPS coordinates (latitude and longitude) to your designated Safe Contacts for the duration of the active trip session;
  • The sharing of trip metadata, including your trip route, estimated arrival, and trip progress, with your designated Safe Contacts;
  • The storage and processing of this location data in accordance with our Privacy Policy.

6.3 Responsibilities of the User

You are solely responsible for:

  • Ensuring that any individual you designate as a Safe Contact has consented to receiving your location data and is aware that they will receive real-time trip updates;
  • The accuracy of the Ajala IDs used to link Safe Contacts;
  • Any consequences arising from the disclosure of your location to designated Safe Contacts.

6.4 Limitations of Guardian Mode

Guardian Mode is provided as a convenience and safety aid. ÀJÀLÁ does not warrant that Guardian Mode will function without interruption or error, particularly in areas with limited network connectivity or GPS signal. Guardian Mode does not connect you with emergency services. In any genuine emergency, you must contact the relevant Nigerian emergency services directly (e.g., Police: 112, Lagos State Emergency Management Agency: 767).

6.5 Revoking Consent

You may deactivate Guardian Mode at any time within the App, which will immediately cease the sharing of your location data with Safe Contacts. You may also withdraw your consent to location sharing by contacting us at admin@ajala.live. Withdrawal of consent shall not affect the lawfulness of processing carried out prior to withdrawal.

7. Crowdsourced Intelligence — Road Condition Reports

7.1 Reporting Feature

Registered Users may submit reports regarding real-time road conditions, including traffic congestion ("Traffic/Slow") or free-flowing traffic ("Clear"), for routes within the Lagos transit network. This feature is intended to provide the broader community of Users with timely and actionable transit intelligence.

7.2 Accuracy and Community Responsibility

The integrity of the Crowdsourced Intel feed depends on the honest participation of every User. By submitting a road condition report, you represent and warrant that the report is, to the best of your knowledge:

  • Accurate and based on your genuine, first-hand or reasonably reliable observation;
  • Submitted in good faith for the benefit of the User community;
  • Not submitted for any commercial, fraudulent, or malicious purpose.

7.3 Prohibited Conduct — Misuse of Reporting Feed

The following conduct is strictly prohibited and constitutes a material breach of these Terms:

  • Submitting false, fabricated, inaccurate, or misleading road condition reports;
  • Deliberately flooding the reporting feed with spam or duplicate reports;
  • Submitting reports intended to mislead other Users, cause traffic congestion, or disrupt transit flow;
  • Using the reporting feature to harass, target, or inconvenience any individual, group, or community;
  • Submitting reports for commercial gain, competitive advantage, or any other improper purpose;
  • Any form of coordinated manipulation or artificial inflation of report data.

Violation of this clause may result in immediate account suspension or termination, as detailed in Section 15. We reserve the right to verify, moderate, weight, or remove any submitted report at our sole discretion.

8. User Conduct and Acceptable Use

8.1 General Conduct

You represent and warrant that your use of the Platform will not violate any applicable law or regulation, including but not limited to the laws of the Federal Republic of Nigeria, the Nigeria Data Protection Act 2023, and applicable consumer protection statutes.

10.3 Moderation
